Amend or end Section 173 - 19P application checklist
To request a change or end a S173 agreement registered against a property title, you need to submit a 19P application.
We will need to approve your proposal in principle before you apply. Contact Planning Services by calling 9433 3343 or email nillumbik@nillumbik.vic.gov.au.
This page outlines the documents that you must have (mandatory inclusions) and other documents you might need to include.
Before you start
Before you apply, you'll need to create an account for eservices. Most registrations are approved within one business day. You'll only need to register once to submit, track and amend your application.

Mandatory inclusions
Your 19P planning application must include:
Certificate of titles
You need to attach a Certificate of Title from Landata copy (dated within the last three months) with a copy of any registered covenants and/or Section 173 agreements.
If the Section 173 agreement affects other landowners, you may also need to provide title certificates for these properties.
Covering letter
Tell us if you are applying to amend or end the agreement and why. If you are applying to amend, specify the relevant clause and parts of the agreement to be amended. Describe how you want to amend it. If applying to end the agreement, explain why it is no longer needed.
Include a list of properties that are subject to the same Section 173 Agreement. You may need a solicitor to assist you.
Additional documents
Any additional plans or reports that are relevant and provide justification for your application.
Check permit application fees
When you submit your application online you will pay a fee. To find out how much your application type will cost go to planning fees.
