Change to land use with buildings/works – 02P application checklist

For proposals to change land use that include buildings and works or signage. Examples include to establish an aged care facility, group accommodation, child care centre, offices, winery, factory or shop.

Before you start

Before you apply, you'll need to create an account for eservices. Most registrations are approved within one business day. You'll only need to register once to submit, track and amend your application.

Mandatory inclusions

Your 02P planning application must include: 

Certificate of title

You need to attach a Certificate of Title from Landata copy (dated within the last three months) with a copy of any registered covenants and/or Section 173 agreements.

Written submission

We need to know details of:

  • land use – current and proposed
  • buildings/works – details of what is proposed
  • how the proposal meets the decision guidelines for the site’s relevant planning scheme zone
  • hours of operation proposed
  • staff/employees - maximum number
  • children – number cared for (for a child care centre)
  • car park – layout plan
  • car parking demand assessment against the requirements of Clause 52.06 of the Nillumbik Planning Scheme and/or justification for the reduction or waiver of the car parking requirement
  • licence – if one is needed for proposed use (as required by the Dangerous Goods Act 1985)
  • liquor licence – if one being sought for the proposed use
  • transport of materials or goods to and from the site
  • goods – type to be stored, processed or produced on the site
  • emissions (eg smoke, noise, smells, lighting) from the land generated as a result of the proposed use
  • rubbish bins location
  • business signage proposed – go to advertising and signage advice

Photographs

Photographs of the subject site can be useful.

Site plan

A plan of your site must be provided that is drawn to scale with dimensions that provides (if relevant):

  • title boundaries – must be clearly shown and labelled
  • setback (distance) of the buildings and works from title boundaries
  • buildings on adjacent properties (including setbacks from the title boundaries of your site)
  • buildings – existing and proposed
  • works – existing and proposed, including quantities of proposed cut and fill
  • vehicle crossovers – existing and proposed
  • setback (distance) of the buildings and works from title boundaries
  • signage proposed – go to put up a sign planning checklist
  • car parking structures, areas and access ways
  • rainwater tanks and other proposed Environmentally Sustainable Development initiatives
  • road reserve features abutting the site - service pits, poles, street trees, drains, footpaths, kerb and channel (guttering)
  • bicycle facilities in line with relevant requirements of Nillumbik Planning Scheme Clause 52.34
  • rubbish bin storage areas
  • lighting proposed.

Proposed floor plans 

You must include floor plans. Include setbacks from boundaries and other key site features. Include a scale and dimensions.

Proposed elevation plans 

Make sure these plans include a scale and dimensions. Locate on the plan and provide details (where relevant):

  • external elevations from North, East, South and West for each building having regard to the natural fall of the land
  • wall heights and overall building heights with dimensions for each elevation
  • natural ground levels and finished surface levels
  • external colours, finishes and materials noted
  • signage proposed – go to put up a sign planning checklist.

Licensed premises 

If you are proposing a licensed premise, your application needs to include details of:

  • type of liquor licence being applied for (go to Liquor Control Victoria)
  • nearby licensed premises - existing premises within 500 metres of your site
  • late openers – how many and type of licensed premises operate after 11pm (especially high capacity venues and packaged liquor outlets) within 500 metres of your site
  • meals – is food part of your proposal
  • music – do you propose background, live or recorded music
  • red line plan (a site plan with a red line around the area where liquor is stored/served).

Other considerations

You may need to include additional information with your permit application if your land is affected by other zones or overlays, or your certificate of title contains a covenant or Section 173 agreement.
