Properties in bushfire prone areas may be subject to the Bushfire Management Overlay. You will need to include a Bushfire Management Plan for some planning permit applications such as a new house, an extension, a shed or other land use.
To find out if your property is affected by the BMO, create a VicPlan planning property report.
Talk to us about your proposal to confirm whether you require a bushfire plan. These requirements are included in Clause 44.06 of the Nillumbik Planning Scheme.
For a more complex proposal you may need to work with a consultant to do a bushfire hazard assessment, a bushfire hazard landscape assessment and a bushfire management statement and report on each in your plan.
Other information to help you prepare your application:
We will assess applications against the BMO and Clause 53.02.
We will refer your application to the CFA (Country Fire Authority). The CFA will advise us what permit conditions it requires or if it objects to the granting of a planning permit.
Permits issued will include conditions that require owners to maintain their land in accordance with the approved bushfire plan.
Planning permits issued for subdividing land subject to the BMO will require a Section 173 agreement to be registered on the title. The agreement will include the bushfire protection measures of the planning permit. These agreements can be complex and you will need to engage a solicitor to prepare these documents.
