Apply for a footpath trading permit

You will need a permit from Nillumbik Shire Council if you want to use the footpath to:

  • display an A-frame advertising sign, or
  • provide outdoor seating facilities (tables and chairs only), or
  • display goods for sale, including display items such as umbrellas, planter boxes, free standing structures etc.

A separate permit is required for each of the above permit types. If you don't have a permit, you may get a fine.

Step 1.Read the permit conditions

Read the permit conditions listed in our Nillumbik General Local Law 1 Procedure and Protocol Manual(PDF, 2MB).

Step 2.Prepare a diagram

The diagram will need to show the:

  • property line, footpath, nature strip and road
  • dimensions of the items you wish to place on the footpath
  • intended position of the items, including the distance from the front of your premises.

Step 3.Make sure you have public liability insurance

You will need to provide evidence of current public liability insurance for a minimum of $20 million.

Fees

The application fee that applies depends on the nature of your proposed footpath activities:

  • A-frames: $128
  • Outdoor dining: $200 first table, $106 each table after the first
  • Goods (for example umbrellas): $214

These amounts are correct as of 1 July 2024.

After your permit application is received, subject to approval an invoice will be generated and emailed to you. This email will contain instructions on how to pay.
